Terms of Use

These terms are an agreement between you and Spectrum Whisper LLC ("we", "us") for the VibeSingSong app and related services (the "Service"). By using the Service you agree to them. If you don't agree, please don't use the Service.

1. Who can use VibeSingSong

You must be at least 13 years old. If you're under the age of majority where you live, your parent or guardian must agree to these terms for you.

2. What you need

You need a compatible iPhone running a supported version of iOS (shown on the App Store page) and an internet connection. We update the app from time to time to add features, fix problems or change how things work; some features may need the latest version.

3. Your account

The app creates an anonymous account on your device; we don't ask for your name or email. Because of this, your account is tied to your installation of the app. If you delete the app or change devices, you may lose access to songs and lyrics made before, so download anything you want to keep. Your subscription can be restored with Restore. You can delete your account at any time from Profile → Account; we may keep limited records where the law requires or to prevent fraud and resolve disputes.

4. Subscriptions

  • VibeSingSong offers auto-renewing subscriptions (weekly and yearly). Prices are shown in the app before you buy.
  • Payment is charged to your Apple ID when you confirm the purchase. Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period; the renewal is charged within the 24 hours before the period ends.
  • You can manage or cancel your subscription in your iPhone's Settings → [your name] → Subscriptions. Deleting the app or your account doesn't cancel it. Cancelling stops future renewals; you keep your plan until the end of the paid period.
  • There's no free trial unless one is clearly offered on the purchase screen.
  • Refunds are handled by Apple under its policies.

5. Coins

  • Creating content uses coins. The cost of each action is shown in the app before you use it (for example, making a song or writing lyrics).
  • Subscriptions include plan coins that are refilled each period (weekly plan: each week; yearly plan: each month). Plan coins don't carry over and end when your subscription ends.
  • Subscribers can buy extra coins. Purchased coins don't expire.
  • Coins have no cash value, can't be transferred or exchanged for money, and are non-refundable except where required by law or when a creation fails. If a song can't be made, its coins are returned automatically.
  • We may change coin costs or plan amounts in the future; changes won't affect coins already in your balance.

6. Your content and the songs we make

You keep ownership of what you give us, such as song ideas and lyrics you write ("Your Input"). You give us permission to use Your Input to provide the Service, including sending it to our AI providers to generate your content.

As between you and us, we assign to you whatever rights we have in the lyrics, songs and cover art generated for you ("Output"), and you may use Output for personal purposes, such as sharing it with friends and family or on social media. Output is created by AI models: it may not be eligible for copyright protection, and similar output may be generated for other users. Commercial use of Output (for example, selling or distributing it on streaming services) is at your own risk and may be subject to the terms of the underlying AI providers.

You're responsible for Your Input and for how you use Output. You confirm you have the right to use any names, words or other material you provide.

7. What you may not do

  • Create content that is illegal, hateful, harassing, sexually explicit involving minors, or that threatens or defames someone.
  • Impersonate real people or artists, or try to imitate a specific artist's voice.
  • Infringe anyone's copyright, trademark or other rights, including by submitting lyrics you don't have the right to use.
  • Misuse the Service: attempt to break, overload, reverse engineer or gain unauthorized access to it, use bots or automated access, or use it to build a competing service.
  • Exploit the coin system or try to get around payment, for example by abusing refunds of failed creations or creating accounts to avoid paying.

We may refuse a request, remove content or suspend accounts that break these rules.

8. AI-generated content

The Service uses AI models to write lyrics and make music. Results can be unexpected: names may be sung differently than you'd say them, and lyrics may contain mistakes. Please listen before you share. Our AI providers may decline some requests under their content policies.

9. Our app and its availability

The app, its design, code, graphics and the VibeSingSong name and logo belong to us or our licensors. You may use the app as allowed by these terms, but you may not copy, modify, distribute or decompile it, except where the law allows.

We're improving the Service all the time and may change, add or remove features, prices and coin rules. We'll try to keep it available, but maintenance, updates, provider outages or connection problems can interrupt it, and we don't promise it will be uninterrupted or error-free.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, WE WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR CONTENT, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

11. Ending these terms

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms. Sections 6, 10 and 13 continue to apply after these terms end.

12. Apple

These terms are between you and Spectrum Whisper LLC, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide support for it, and isn't responsible for any claims relating to it, including product liability, legal or regulatory compliance, or intellectual property claims. If the app fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price of the app; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm you're not located in a country subject to a U.S. government embargo and aren't on any U.S. government list of prohibited parties. Apple's Licensed Application End User License Agreement also applies where these terms don't cover something.

13. Governing law

These terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise.

14. Changes to these terms

We may update these terms. We'll change the date above and, for significant changes, tell you in the app. Continuing to use the Service after changes means you accept them.
